Subject: DOL non-enforcement of the H-1B visa LCA standards and request for suspension of LCA approvals

 

Dear Secretary Chao,

 

The “high tech bubble” has burst. At least 500,000 U.S. tech workers are unemployed. U.S. corporations are blatantly displacing qualified Americans with foreign workers, sometimes forcing the Americans to train their foreign replacements. Additionally, the large corporations that utilize nonimmigrant visas to facilitate the transfer of their operations overseas jeopardize the long-term viability of the U.S. economy.

 

These detriments are largely due to the DOL approving over 500,000 LCAs for nonimmigrant visas -- including the H-1B and L-1 visas -- in the past few years alone. DOL's rapid LCA approval process does not assure that the statutory and regulatory rights of U.S. citizens to work in their chosen profession have been duly protected, as mandated under federal laws and regulations. DOL's approval of these LCAs has caused clear and documented harm to U.S. citizen workers, with a direct correlation to rising levels of unemployment and under-employment.

 

This program has been widely abused and misused by U.S. employers and alien guest workers -- as documented by the Office of Inspector General and the Immigration and Naturalization Service (now BCIS). Qualified U.S. citizen workers have been notified that their jobs will end after they train the H-1B visa holders to take over those jobs. This is not the intended purpose of the H-1B visa program, and must end.

 

·        We request that the U.S. Department of Labor aggressively investigate these abusive practices that have been reported at various companies. In order to facilitate your investigation, we ask that your department establish a dedicated toll-free number for US workers to report companies engaged in these practices.

 

·        The typical H-1B nonimmigrant temporary workers are neither better qualified nor better educated than the American citizens they are replacing – but they are cheaper. The H-1B visa program was not intended to under-cut the wages of gainfully employed U.S. citizens. Federal statute as well as 20 CFR Parts 655 and 656 prohibit employers from paying the H-1B visa holder less than the prevailing wage for the particular job hired. Yet, the Office of Inspector General has repeatedly reported before the U.S. Congress that under-payment of H-1B visa holders is widespread and has adversely impacted the wages of similarly situated US citizen workers.

 

The H-1B visa program was allegedly established to address a shortage of U.S. workers.  As U.S. Citizens, we dispute the premise used by Congress that we, American citizen professionals, are unwilling, under-skilled, and under-educated professionals in our respective fields. Indeed, President Bush, while speaking in California less than 18 months ago, declared in California that U.S. citizens are the best workers in the world.

 

Meanwhile, in the past three years, the unemployment rates for U.S. citizens has increased with each passing month as employers continue to separate skilled, creative, and dedicated American citizen workers from their jobs. The difficulty in finding replacement work is amplified by the fact that the U.S. Congress in the current session was forced to extend unemployment benefits from six months an additional thirteen (13) weeks.  Still, these U.S. citizens are unable to find employment and the hardship being placed upon U.S. families is unimaginable.

 

We therefore respectfully request that you take the steps outlined in this letter on behalf of U.S. workers. We have faith in your statement, "Getting people back to work is what this Department does. Giving people hope in their future is our job."  We are American citizens who are unemployed or severely under-employed and who have no hope in our future without the ability to return to work.

 

We request that the DOL take the following immediate actions:

 

1.      Suspend the approval of all H-1B Labor Certification Attestations (LCA) requests for six months.

 

2.      Call on Congress to restore adequate worker protections to the nonimmigrant visa statutes, such as requiring that all LCAs demonstrate a lack of qualified U.S. workers, and a due process means of excluded U.S. workers to challenge LCAs.

 

3.      Conduct an investigation into the employer abuses of having US citizen workers train their replacement alien workers who hold H-1B visas.

 

4.      Conduct an investigation into the actual pay given to H-1B visa holders vs. what employers report on the LCA forms.

 

5.      Prosecute to the fullest extent possible employers who have misrepresented sworn facts to the U.S. Dept. of Labor, including enforcing debarments of all companies from visa programs that have misused the H-1B visa program.

 

6.      Investigate fraud on the part of H-1B visa holders and prosecute them for making false statements about their work and educational histories. This would include placing on notice any alien educational institutions and/or employers that aided and abetted such abuse and fraud against the United States.

 

7.      Hold state level public hearings to collect information on the victimization of U.S. citizen workers by employers who have abused the immigration laws.

 

8.      If DOL hasn't yet developed the pamphlet on US citizen worker rights and how to protect those rights, that this material be developed immediately and made readily available to all displaced US citizen workers. This information for public use is mentioned in the 20 CFR Parts 655 and 656 of December 20, 2000.

 

We are prepared to work with your staff on these matters. Many of us have direct experience training H-1B visa holder replacements for jobs that we held.  Many can document H-1B visa holders being given jobs in which unemployed, skilled, educated, and willing American workers were excluded. The diverse means that employers have developed in the past decade to separate American workers from their jobs is simply shocking. Most of us have experienced at least one such practice.

 

On April 15, 2003 in Chicago you stated, "One person out of work is one person too many," and that, "We will never be satisfied until every American who wants a job can find a job." This conflicts with DOL’s policy of issuing LCAs to employers that don’t recruit from the 500,000 unemployed American tech workers, and to foreign entities whose primary objective is to transfer U.S. jobs overseas.

 

While the BLS data on DOL's own website claims that Software Engineering starting salaries range from $62,750 to $92,000, DOL has approved thousands of programmer LCAs for as low as $28,000. (Ref: I-02282-0273653)

 

To paraphrase you, we ask that you ‘Get us back to work, which is what this Department does' and [give us] hope in our future, which you have stated, is the job of the US Department of Labor.'

 

Thank you for your time and attention to our letter requesting your assistance with these issues that have harmed U.S. citizen workers. We respectfully look forward to a written response within ten days of receipt of this letter, and we offer our cooperation in working with you and your staff. Those contractor jobs that were lost in the Pacific NW did not cease to exist -- they were outsourced to India. How many jobs have been sent offshore in the virtual smokescreen provided by the calamity in New York? It isn't just about the one issue of H-1B visa holders; it’s about the catastrophic effects of globalization. My mortgage payment is but a mirage. I have 2 skill groups with which I am trying to find gainful employment: 21 years, mainframe and 6 months training in Web Technologies. I am not just pessimistic about the future for the hundreds of thousands of displaced IT workers in the United States, I am downright afraid.”
