PERM Fake Job Ads in Sunday June 24, 2007 Pittsburgh Tribune-Review

On June 23rd the
Tribune-Review reported that law firms are running fake job ads for PERM
processing. A "quick match" for Computer/IT returned seven matches.

suspect PERM job ads, run with the intent of excluding all qualified U.S.
applicants to demonstrate that "no qualified Americans are available."
1) Software Engineer

ANALYSIS: PERM requires recruitment in multiple sites. This
position is currently advertised
on their website. Consistent with PERM, no salary is specified. This ad is tricky: It lists several skills used and
"five years of experience" - but does not specify that the experience must
be in those skills. Legally the PERM requirements cannot list skills that
the H-1b learned on that job. But in practice these skills will be used as
the checklist to disqualify all American applicants. Gigaforce has
sponsored
several LCA for "Software Engineer" in the past. The LCA sponsor is an
Indian: Raj Yellavala - President. Their phone # is
(412) 531-9444. If anyone investigates I suspect
that they will find a bodyshop of several programmers, nearly all of Indian
descent. (Their website conceals all ownership information, and Google for
just the last name "Yellavala" only returns one match - odd that any last
name would not find several matches. His
Honda for sale is still on the gigaforce website.)
2) Computer Programmer

Computer Programmer To design, develop, customize,
test and document computer software and intranet/web
portals using Java, J2EE technology & CMS software
such as of RedHat CMS, OpenCMS, PhpNuke and Aplaws.
Applicant must have at least
1/2 yr work experience

ANALYSIS: This one is pretty clear PERM, since the resumes are
sent directly to the PERM processing center. This is likely a PERM ad that
was rejected, so the employer is being given a second change. The ad is
clearly written to exclude American applicants: If someone possesses all of
the skills, why should it matter whether they have a BS or MS? Why is Sun
Certification necessary? Why is exactly 1/2 year of experience required?
ANSWER: Because the H-1b worker who is getting a green card happens to have
an MS degree, just took a course and got a certificate, and has been in the
job for six months. It's unfortunate that DOL does not disclose the name of
the actual employer.

are available? Or immigrants sponsoring fellow immigrants for a green card?

3) Operations Research Analyst

ANALYSIS: In 2005 one
G. Briton Motheral was arrested for sexual assault on a 15
year old. Google finds an address of 400 Hastings St
Pittsburgh, PA 15206, (412) 441-6060,
which appears to be a residence. Neither of these mean
much. What is odd is that an apparently home-based
real-estate company would have a need for computer
programmer, and that the job would be so specialized as to
require a masters degree, and that one of the
requirements be that the candidate already have "one year of experience
in the job offered." The latter is an illegal PERM
requirement, but at the speed that DOL is expediting PERM
processing,
it will probably slip through.
