Fake RIR/PERM job ads in Sacramento Bee

The DOL PERM regulations have been updated to automate and streamline to process. In his article Legal Rejection of U.S. Workers, immigration attorney Joel Stewart explains how:

"Even in a depressed economy, employers who favor aliens have an arsenal of legal means to reject all U.S. workers who apply." - Joel Stewart - author "The PERM Book"

A key to that "arsenal" is the fake job ads that the Bee continues to knowingly run. On December 26th we advised the Bee that the SoftMatrix ad was fake": http://www.programmersguild.org/rir/sacbeeletter_26dec2004.html

Yet you ran the same ad again today. Consistent with the fraud, the founders of SoftMatrix are from India (http://sacramento.bizjournals.com/sacramento/stories/2001/12/10/smallb1.html) FY 2004 LCAs for SoftMatrix pay $45k/year. In 2003 SoftMatrix secured several LCAs for programmers paying $38,000 per year.

Yet the Bee's Editorial position is that we need MORE such workers displaying Americans - and that Americans opposing the the program are Xenophobes? It appears that CompeteAmerica played a role in this editorial. A website Compete America Trust reveals more about the people (Sandra Boyd) and companies behind CompeteAmerica

I understood that the Bee's policy was to respond to legimate concerns about it's content. Yet in a month no Editor nor the new Ombudsman has acknowledge our concerns. WHY ARE YOU KNOWNINGLY RUNNING FAKE ADS THAT DEFRAUD YOUR READERS AND SUBSCRIBERS?

My December 20th letter (http://www.programmersguild.org/RIR/sacbeeletter_20dec2004.html) raised the issue of whether the NTI ad was bogus, and why NTI had the same address as well-known "Unify."

Doreen Paige of Unify HR told me that NTI is "NetTeam Inc" which has software contractors within Unify. The Bee may avoid the issue with ad hominem attacks that I am "Xenophobic." But once again the NTI fake ad is from a company whose CTO and two VPs are from India: http://www.netteam.net/comp_management.html the ONLY opening on their website is the same RIR ad - which is likely already filled with an H-1B: http://www.netteam.net/career.html As Joel Stewart states above, qualified Americans zero chance of securing this job, since RIR and H-1B authorize foreign nationals with the U.S. to discriminate if favor of their own nationality. Statistically it appears that disproportionately it is Indian companies and CEOs that cannot find "qualified Americans" - whereas the vast majority of U.S. companies and managers is having no problem selecting from the flood of U.S. resumes in this down market.

Gordev Hora - listed as "President" in the following LCAs, is the NetTeam contact within Unify: GURDEV HORA - 916-928-6363. He did not return my voicemail asking whether the ad in the Bee was for RIR for a current employee.

The Bee reported that Hora complained to President Bush about the racism he encounters in the USA: http://www.sacbee.com/content/news/projects/attacks/story/1086055p-1090128c.html - yet the Bee did not label him a Xenophobe -- the Bee reserves that title for native Americans who raise legimate concerns about the fraud in their publication.
