Sacramento Bee - PERM Fake Job ads on October 4, 2009

Dear Editors, Sacramento Bee,

I have cc'd the employers who placed these ads and invite them to "reply all" if my allegations are false. I will promptly print any corrections.

I have been alerting your to these ads for the past four years: www.programmersguild.org/RIR/. Yet in today's October 4, 2009 Sacramento Bee, the majority of the Computer, Engineering, and Information Technology help wanted ads appear to be fraudulent PERM ads.

I have repeatedly asked for clarification on your policy on running "help wanted" ads to do not represent a bona-opening and intent to hire one of the applicants. So far no one at the Sacramento Bee has clarified your policy.

I have alleged that every Sunday the Sacramento Bee runs PERM jobs ads, which you should know are only being run as "labor market tests."

The advertised positions do not exist - they are already filled by foreign workers - typically on H-1b visas. Employers only run these ads to file copies of them with DOL as evidence of “good faith” recruitment attempt (labor market test) to obtain a green card for the foreign worker who already holds that job – “good faith” as defined by immigration attorneys: www.youtube.com/programmersguild/.

According to DOL, even if qualified Americans apply, the employer can continue employing the H-1b foreign worker rather than hiring a qualified American. (Reference: See highlighted section at the bottom: www.programmersguild.org/RIR/PERM_After_Fragomen_Settlement.html)

You are knowingly misleading your readers, some of whom desperately need jobs and invest much time writing up cover letters and applying for these jobs.

 

ENGINEERING JOBS

There are only four "ENGINEER" help wanted. Three appear to be PERM sham ads. Only the "City of Merced" appears to be a bona fide ad.

 

1. Auerbach Engineering

The ad specifies only basic skill requirements of "perform surveying, process data, cartographing, civil engineering tasks, etc. It does not specify any years of experience, but does specify that the candidate must have a master's degree. It then directs that applications be snail-mailed to a P.O. box.

Oddly this job does not appear on their website. The only job on their website is for "Project Manager." The Project Manager job does not require a masters
degree. And for this job applicants are invited to email their resume to kiler@auerbachengineering.com

Analysis and Allegations

This is a PERM sham ad. This position is already filled by a foreign worker.

There is nothing about this job description at requires a masters degree. The employer is only requiring a masters degree as a means of reducing the field of qualified American applicants - because the foreign worker happens to have a masters degree.

Applicants are directed to snail-mail their applications rather than email them so that that Americans have no means of proving that they had applied. In contrast the "project manager" position allows resumes to be submitted via email.

This is an entry-level job. It's likely that the foreign worker learned most of their knowledge of CarlsonSurvey on the job. It would therefore be a violation of PERM regulations for the employer to make such a requirement of other applicants.

 

2. Stratus Environmental

This is an entry level Surveyor position that does not specify any prior experience.  But, like the Auerbach ad, it does specify that the candidate must have a master's degree. It then directs that applications be submitted via fax.

Analysis and Allegations

Their website is a joke. They have no "what we do" or even email or web contact information. Most visitors would doubt whether this organization is a bona-fide engineering firm. Stratus Environmental previously filed an LCA for an H-1b "Project Manager" - See Row 6 in this Excel file. The LCA indicates a wage of $57,000.

There is nothing about this job description at requires a masters degree. The employer is only requiring a masters degree as a means of reducing the field of qualified American applicants - because the foreign worker happens to have a masters degree.

Contrast with their ad at this URL: http://books.dreambook.com/chicoisa/main.html  where they do not require a masters degree, and they allow resumes to be emailed to hr@stratusinc.net.

The "webmaster" email is gkowtha@stratusinc.net Google returns one match to an evite in Folsom, California (only a few miles from their Cameron Park address). This has got to be seen - over 500 people invited, and 99% are Indian: evite - evite-archived


3. ICF Jones and Stokes

This ad does not give any job descriptions. Instead it directs applicants to their url: www.jonesandstokes.com.

Analysis and Allegations

The ad lists three jobs:

But go here https://jobs.icfi.com/joblist.html and search for keywords "wildlife," "climate," and "historian" and there are no matching jobs. However they did file an LCA for a "Wildlife Biologist - Senior Consultant I" -  See Row 10 in this Excel file. The LCA indicates a wage of $46,966.

 

COMPUTER JOBS

There are only two "Computer" help wanted. At least one of them is a PERM fake ad.

 

4. Adventist Health

This ads seeks 3 analysts with 2+ years recent experience in iSeries operations (which is an IBM AS400).

Analysis and Allegations

I do not allege that these particular ads are PERM for lack of sufficient information. What is interesting is that they had filed an LCA for a "CIS Project Director" at a wage of $165,000!  See Row 2 in this Excel file.

 

5. Verifone

The ad seeks and "IT Business Solutions Analyst II," then directs applicants to snail-mail their application.

Analysis and Allegations

This is a PERM sham ad. This position is already filled by a foreign worker.

Verifone filed many LCAs for H-1b workers. See Row 19 in this Excel file for the one matching this job ad.

Only the IT Business Solutions Analyst II contains the phrase "5 years of ... experience in the job offered" and mentions a "foreign degree equivalent." (It is a violation of PERM requlations to give any weight to experience gained within the present job.)

INFORMATION TECHNOLOGY

There are only two "Information Technology" help wanted. One of them is a PERM fake ad.

6. Electronic Data Systems

This ad for Information Specialist specifies a masters degree.

Analysis and Allegations

This is a PERM sham ad. This position is already filled by a foreign worker.

EDS filed many LCAs for H-1b workers. See Rows 25, 26, and 28 in this Excel file for positions matching this job ad. contains the phrase "3+ years experience in the job offered" and mentions a "foreign degree equivalent."
